I. Preliminary remark Data protection

In thefollowing, we explain the processing of your personal data by us when using thePlactron app (hereinafter also "Plactron app" or "App")as well as our website www.plactron.com and the web application accessiblethere for booking for subscriptions or managing content for artists.

Personaldata is any information relating to an identified or identifiable naturalperson (also referred to as "data subject"). In this context, anatural person is considered to be identifiable if he or she can be identifieddirectly or indirectly, in particular by means of an association with anidentifier such as a name, an identification number, location data, an onlineidentifier or one or more special features that are, for example, an expressionof the economic, cultural or social identity of this natural person.

Privacysettings in the app: The processing of personal data of the user, can beviewed, updated and adjusted via the "Privacy setting" in the app.You can request the personal data stored about you by sending an email to datenschutz@plactron.de.

Notificationsettings: The notification settings allow you to select which notifications youwould like to receive in the Plactron app or via email, etc. You can also usethis to manage the publicly visible personal data and define your sharingsettings.

II.Who is responsible for data processing?

Responsiblefor data processing is the

Plactron GmbH, Zweigniederlassung Stein am Rhein, Obergass8, 8260 Stein am Rhein, Switzerland, datenschutz@plactron.com hereinafter also"Plactron" and "we", "us", "our".

III.What personal data is collected and processed?

Both whendownloading the app, using the app in the free area and purchasing music viathe Plactron app and the Plactron web application, your personal data iscollected and processed by us. The details of data processing can be found inthe following description of the individual processes.

1.when you download the app

To downloadthe app via your chosen app store platform, you must first view the privacynotices of the respective platform. Data processing in the context of the useof the app platform selected by you is the sole responsibility of the providerof the selected app store platform. Plactron has no influence on the dataprocessing of the app store platforms used by you.

2.when you use the app: App permissions

As soon asyou have downloaded the Plactron app anduse the app, the app collects data that is technically necessary for the use ofthe app, in particular to be able to start and display you on your terminaldevice. This is the following data and data categories:

This datais transmitted to Plactron or its server for processing, but is not storedpermanently. This data is used to be able to provide you with the services andfunctions of the app, to improve the functions and performance features of theapp and to prevent misuse.

Theaforementioned data collection is based on the usage contract initiated and/orconcluded between you and Plactron (contract initiation and fulfillment, Art. 6para. 1 b) DSGVO) as well as on Plactron's legitimate interest in protectingthe functionality of the app against misuse and maintaining a functionalitythat corresponds to the user interest and the market interest (Art. 6 para. 1f) DSGVO).

The appalso requires the following permissions mandatory to use the app and fulfillthe contract:

●      Internet access: Without internet access, the app cannot store your dataentries on the servers used by Plactron and process your requests.

●      Location: Without a location query, we cannot process your orders due tolicensing requirements. We will, to the extent legally and technicallypossible, limit localization to the country from which you submit your orderrequest.

Theprocessing and use of the aforementioned usage data takes place for theprovision of the services requested by you in the app. This data processing isbased on the fulfillment of the contract with you. The usage data is necessaryin each case to enable the fulfillment of the contract between you and Plactron(Art. 6 para. 1 b) DSGVO).

The app mayalso request the following authorization from you for voluntary use:

●      Bluetooth: You can voluntarily grant the app access to your Bluetooth®interface in the smartphone, e.g. to listen to music via headphones usingBluetooth® connection.

●      Camera access: You can voluntarily grant the app access to your camerain your smartphone, e.g. to take photos and use them within the app (e.g.profile picture creation).

●      Microphone: You can also voluntarily record a message within the app viathe microphone icon and have it converted to text. This is enabled via aninterface of the app to your mobile device settings

●      Pictures: You can voluntarily grant the app access to your photo folder,e.g. to be able to use photos you have already taken within the app (e.g.profile picture creation).

Theprocessing and use of this voluntarily provided data takes place for theprovision of the services requested by you in the app. This data processing iscarried out to fulfill your service request. The usage data is necessary ineach case to enable the fulfillment of the service you have voluntarilyrequested between you and Plactron (Art. 6 para. 1 a) DSGVO). You can revokeyour consent for the future at any time via the system settings of yourterminal device (deactivate access).

 

3.registration

a)When you register in the app: User data for the user account

Within thescope of the registration for the use of the app, Plactron collects bothmandatory and voluntary information (user data).

Withoutproviding the marked mandatory information, you will not be able to use theapp, i.e. you will not be able to log in/register. The mandatory information isused to identify you, your age, and to verify the authorization of the use ofyour account, to reset your password, to prevent misuse, and to send importantnotifications about any changes to the privacy information, terms of use,security notifications, updates, account data management, and new features ofthe app. Mandatory information is marked as such.

This dataprocessing is carried out on the legal basis of contract performance, i.e.within the framework of the usage contract concluded between you and Plactronwith regard to the app (contract performance, Art. 6 para. 1 b) DSGVO).

You canvoluntarily add the following information in your user account:

You canwaive the use of individual services of the app and do not have to complete allinformation in the menu "My profile" when using the app. Plactronprocesses the voluntary information based on your input in order to be able toprovide further services of the app for the respective fulfillment of thecontract, i.e. for the provision of the service (Art. 6 para. 1 b) DSGVO).

Currently(as of March 2021), it is not yet possible to log in to our app via useremail/social media accounts. If we offer this option in the future, you willuse third-party services for login (email/social media account login), i.e. wewill receive your personal data from the third-party provider if you have consentedto the transfer in detail.

b)When you register on the website: Subscription registration

If you wantto book a Plactron subscription, you must log in to the plactron.com websitewith your user data or register first.

When youuse our website, we first collect the personal data that your browser transmitsto our server. If you wish to view our website, we collect the following data,which is technically necessary for us to display our website to you and toensure stability and security

The legalbasis for the collection of this data is Art. 6 para. 1 f) DSGVO.

Cookies

In additionto the previously mentioned data, cookies are stored on your computer when youuse our website. Cookies are small text files that are stored on your harddrive assigned to the browser you are using and through which certaininformation flows to us. Cookies cannot execute programs or transfer viruses toyour computer. They serve to make the Internet offer more user-friendly andeffective overall.

We usecookies and pixel tags, among other things, to track website usage andunderstand our customers' preferences (e.g., country and language selection).This enables us to provide services to our users and improve their onlineexperience. We also use cookies and pixel tags to obtain aggregate data aboutweb site traffic and interaction, to identify trends, and to obtain statisticsto help us improve our websites. 4.when you use the app (usage data)

When youuse the Plactron app, the following personal data is collected and processed:

●        Certain technical data used to provide the App (URL  information; online identifiers including cookie data and IP addresses;  information about the types of devices you use, such as unique device IDs,  network connection type (e.g., 3G, LTE, Bluetooth), provider, network and device  performance, browser type, language, digital rights management enabling  information, operating system and version of the Plactron App; device  attributes of devices on your wifi network that are available to connect to  our Service (such as.e.g., speakers); their non-exact location, which may be  inferred or inferred from certain technical data (e.g., your IP address,  device language setting, or payment currency) to fulfill geographic  requirements in our License Agreements and to deliver personalized content  and advertising to you; and motion-generated or orientation-generated mobile  sensor data (e.g., accelerometer or gyroscope)) necessary to provide certain  features of the Plactron App.

 

5.when you buy music or subscribe (via app/website).

If you wishto make use of paid Plactron content, you must provide additional information(e.g. billing address, payment data depending on the payment method) in orderto purchase and use the Plactron content.

Inprinciple, you will not be charged for logging in to and using the Plactroncontent that can be freely accessed via the app. Without entering the requiredpayment data, you cannot use the corresponding chargeable functionality.

Plactronuses your billing data exclusively for the billing of chargeablefunctionalities according to the offer or the extent of your use.

Dependingon the type of data relevant for billing, the processing is based on severallegal bases. If Plactron processes data such as your name, address, credit cardinformation and/or bank data, the processing is based on Art. 6 (1) b) DSGVO.In the case of in-app purchases, the payment and the processing of the paymentdata is carried out exclusively by the app platform of the user. Plactron onlyreceives the information that the payment has been made in the case of in-apppurchases.

6.advertising measures Inn-App / notifications by e-mail / newsletter

We use youre-mail address for the purpose of sending you information, i.e. to inform youabout the conclusion of contracts, changes to the functions of the app and servicesoffered therein (orders, subscriptions and offers for these) as well as aboutthe company's own products and services. The provision of an e-mail address issufficient. The legal basis for this processing is Art. 6 para. 1 lit. c), f)DSGVO (our legitimate interests to inform you about our services, fulfillmentof legal information obligations).

In the caseof direct marketing, you have a general right of objection, which isimplemented by us without specifying a particular situation. If you wish toexercise your right of revocation or objection, an e-mail todatenschutz@plactron.com is sufficient.

Furthermore,you can subscribe to our newsletter with information about our services andservices of third parties. The legal basis for this processing is Art. 6 para.1 lit. a), f) DSGVO. You can revoke your consent free of charge at any time forthe future.

7.when you contact us

If youcontact us, your request including all resulting personal data (contact type,date, name, request, and other data provided by you) will be stored andprocessed by us for the purpose of processing your request. We do not pass onthis data without your consent.

Theprocessing of this data is based on Art. 6 (1) lit. b DSGVO, if your request isrelated to the performance of a contract or is necessary for the implementationof pre-contractual measures. In all other cases, the processing is based onyour consent (Art. 6 (1) (a) DSGVO) and/or on our legitimate interests (Art. 6(1) (f) DSGVO), as we have a legitimate interest in the effective processing ofrequests addressed to us.

The datayou send to us via contact requests will remain with us until you request us todelete it, revoke your consent to store it, or the purpose for storing the datano longer applies (e.g., after your request has been processed). Mandatorylegal provisions - in particular compliance with statutory retention periodsand fulfillment of obligations to provide evidence - remain unaffected.

8.in the future: when you use the "Share" function.

We are constantlydeveloping our services and functions. Currently, we do not yet offer aso-called "share" function.

However, ifwe offer this feature in the future, this is how we expect to process yourdata: The app allows you to share content using the standard functions of yourend device via other services, for example, via email or on social networkswhose apps you have installed or are logged in to. Only when you actually tapthe share function is the data transferred to the operating system of the end deviceand from there to the respective app (e.g. email program, etc.). Furtherprocessing of the data is governed by the privacy statements of the respectiveapps.

The purposeand scope of the data collection and the further processing and use of the databy social networks, as well as your rights in this regard and setting optionsfor protecting your privacy, can be found in the privacy notices of therespective networks.

9.if you want to exercise your data subject rights and contact us

We will notdisclose your personal data to third parties for the purpose of requestinginformation or otherwise asserting your rights as a data subject, unless thisis necessary for the assertion of or defense against legal claims or for proofof compliance with our obligations vis-à-vis the data protection supervisoryauthority.

Yourpersonal data will be used by us after processing your input on the datasubject rights for evidence purposes vis-à-vis the data protection supervisoryauthorities and stored for this purpose. This means that we will only processor store your data in order to be able to prove that and how we have respondedto your request. This means that we will continue to store this data for 12months from the end of the calendar year in which we received your input as adata subject for this purpose and will then delete it if it is no longerrequired for the defense against or assertion of legal claims.

Thisprocessing of your data is necessary to protect our overriding legitimateinterests and to fulfill our legal obligations. The legal basis for theprocessing of your personal data in the context of asserting your data subjectrights against us is Art. 6 (1) c) and f) DSGVO. As we are accountable to dataprotection supervisory authorities as a data controller (Art. 5 DSGVO), ourlegitimate interest in demonstrably complying with our legal obligations tosupervisory authorities and in being available and allowed to be used in theevent of defense against and assertion of legal claims outweighs this.

10.when you apply to us

If youapply as an applicant for open positions with us or one of our affiliatedcompanies, with which we conduct the application process jointly in each case,we process the following data:

We processthe personal data that we receive from you yourself as part of your applicationor expression of interest. This is the data that you provide to us as part ofyour application or expression of interest, in particular by submitting theapplication documents and the information you provide during interviews.

Theprovision of your personal data (previous professional and / or educationalbackground, your qualifications, your skills and information about yourself,contact details), is necessary so that we can find out whether you as an applicantand the positions to be filled fit together and we can make a personnelselection. Without the provision of personal data by you as an applicant, nopersonnel selection or application process can be carried out. Consequently,failure to provide personal data will mean that you cannot be considered as acandidate for the vacancy.

Only if yougive us your own (informal) consent to actively contact you in order to offeryou further vacancies with us or one of our affiliated companies afterrejection, will the processing period be determined by the purpose of theconsent given.

We processyour data only if the processing is permitted by law or if we have receivedyour consent to process the data:

Processing of your data for the purpose offilling a vacancy (Art. 6 para. 1 b) DSGVO, § 26 BDSG)

The dataprocessing is carried out for the purposes of personnel selection to fillvacancies, i.e. to initiate employment contracts.

Processing of your data based on legitimateinterest (Art. 6 para. 1 f) DSGVO)

In additionto processing your data for the purpose of initiating a contract, we alsoprocess your data on the basis of our legitimate interest or the interest of athird party - unless your interests merit protection.

Defense against and assertion of legal claims

Inaddition, we store data of applicants in order to be able to defend ourselves,if necessary, against asserted claims, for example under the AGG. We disclosepersonal data to offices, authorities and courts if this is necessary to defendourselves in legal disputes or to enforce legal claims.

Processing of your data due to legalrequirements (Art. 6 para. 1 c) DSGVO)

Furthermore,data is processed if we are obliged to do so by law. This includes feedback tothe employment agency as well as information to offices, authorities andcourts, if we are obligated to do so.

Dataprocessing also takes place if and to the extent that you have voluntarilyconsented to data processing pursuant to Art. 6 (1) a) DSGVO. The purposes forwhich data processing takes place within the scope of this result from therespective declaration of consent.

IV.We receive your personal data partly from third parties

You log  in to the Plactron app via your  user accounts with other providers. In this case, we receive your personal  data for registration and user access from these third parties.

Payment service provider

Depending  on the payment method, we receive your personal data to create an invoice,  process the payment and provide the products. In the case of in-app  purchases, payment processing is carried out via the platform you have  chosen, subject to its terms and conditions.

If you  choose a payment method/product that is not purchased via the Inn app  purchase, you will be redirected to the payment provider's website to  enter/verify your payment data after completing the order process (order with  obligation to pay). This data is processed solely by the third-party  provider. We only receive the information whether the payment could be  successfully verified and carried out so that we can provide you with the  purchased title/album/subscription for download.

Technical service partners

Certain  technical data is provided to us by technical service providers, such as the  mapping of IP addresses to non-exact location data (e.g., city, state), so  that we can provide the Plactron app and  its content and features in compliance with licensing requirements.

Furthermore,  we receive data via/from our application hoster and programmers (processors)  who support us in the technical implementation of the app and its functions.

Cooperation partner

We are  constantly developing our app functions. This includes the possibility to get  in touch with cooperation partners like (studios, online stores for music  equipment, merchandise providers, ticket stores, consultants, intermediaries,  etc.).

In the  case of individual cooperation partners, we may then receive information  about whether you have concluded a contract there, redirected from our app to  the page of the cooperation partner. We do not receive any further  information.

 

Any receiptand disclosure of personal data is justified by the fact that we have alegitimate interest in adapting our offers/services to the economic and legalcircumstances as required and thus also to comply with your rights andinterests in the lawful use of our offers/services in compliance with legalrequirements (e.g. licensing requirements) and to protect you against misuse ofyour data.

V.We partially transfer your personal data to third parties

You  register in the Plactron app via  your user accounts with other providers. In this case, we receive your  personal data for registration and user access from these third parties. The  authentication partner receives your request for logging into our app. You  can ask your authentication partner which data it collects and processes for  this purpose.  

Viewable profile data

Your  username, your profile picture, which users and artists you follow and who  follows you as a user, the last music albums/tracks you played and your  shared playlists, if any, are visible to other users and artists in the  Plactron app.

It is  planned that in the future you will be able to share further details and  information for publication via the Plactron app (e.g. via the  "Share" function).

Payment service provider

For  in-app purchases, payment processing will be done through the platform you  choose on their terms.

If you  choose a payment method/product that is not purchased via an in-app purchase,  you will be redirected to the payment provider's website to enter/verify your  payment data after completing the order process (order with obligation to  pay). This data is processed solely by the third-party provider. We only  receive the information whether the payment could be successfully verified  and carried out so that we can provide you with the purchased  title/album/subscription for download.

Technical service partners

Certain  technical data is provided to us by technical service providers, such as the  mapping of IP addresses to non-exact location data (e.g., city, state), so  that we can provide the Plactron App and  its content and features in compliance with licensing requirements.

Furthermore,  we receive data via/from our application hoster and programmers who support  us in the technical implementation of the app and its functions. We therefore  work with service providers (so-called processors) who support us. For the  operation of our app, we use service providers that we have carefully  selected and with whom we have concluded corresponding contracts for order  processing to comply with the regulations from the DSGVO and the BDSG.

Cooperation partner

We are  constantly developing our app functions. This includes the possibility to get  in touch with cooperation partners like (studios, online stores for music  equipment, etc.).

Thus, if  you call up the offers of our cooperation partners via the app, information  may be collected from these cooperation partners about the  application/website via which the user's request was forwarded.

Collecting societies

The order  of individual music titles, albums, lyrics, music videos and other  retrievable content are recorded for licensing reasons and for billing  purposes. Data collected in the course of the recording process will be  treated as strictly confidential and will not be published under any  circumstances. In individual cases, the data may be passed on to one of the  collecting societies that represent the interests of the artists who are  registered with them (e.g. GEMA) and whose content you wish to purchase, in  order to enable the participation of the artists in the use of their works as  provided for under copyright law.

Fulfillment of legal  obligation

Your data  will be transferred to public authorities, including tax authorities, law  enforcement agencies, data protection supervisory authorities, lawyers,  courts or the employment agency (in the case of applicants) if a legal  obligation exists. In addition, data will only be transferred to third  parties if this is necessary for the above-mentioned purposes, is permitted  by law, you have given your prior consent or this is necessary for the  defense against or assertion of legal claims against you/us.

Legal succession

In the  course of the further development of Plactron and its business model, the  structure of Plactron may change. This may occur, for example, through a  change in legal form, or subsidiaries, parts of companies or components may  be founded, bought or sold. In such transactions, your customer information may  be transferred along with the part of Plactron being transferred. In any  transfer of personal information to third parties to the extent described  above, Plactron will ensure that it is done in accordance with this Privacy  Notice, applicable data protection law and after informing you.

Any  disclosure of personal data is justified by the fact that Plactron has a  legitimate interest in adapting our corporate form to the economic and legal  circumstances as required and that your rights and interests in the protection  of your personal data within the meaning of Art. 6 (1) f) DSGVO are not  overridden.

Data analysis, research

For the  purpose of conducting scientific analysis, studies and research, we may share  pseudonymized (anonymized to the extent possible) personal data with third  parties in order to improve our services and offerings and tailor them to the  needs of our users and artists.

 

Furthermore, we do not pass on your data to third parties, either for afee or free of charge, without your permission. We only transfer your personal data to serviceproviders and cooperation partners who are not our order processors if there isa legal basis for this, e.g. if you give your consent for this, yourregistration in the Plactron app or request the services of these thirdparties. You have the option to change your mindat any time and revoke your consent free of charge with effect for the future.

For example, you may provide yourpersonal data to artists, record companies or other partners who wish to sendyou news or promotional offers directly. This data processing is theresponsibility of the third party.

VI.How long is personal data stored?

Yourpersonal data will be stored for the duration of the contract and then untilthe specified purpose is achieved with a subsequent review period and, ifnecessary, archived for a retention period to be observed (e.g. for contractsand invoices, of at least 6 years from the end of the calendar year) and thenirrevocably deleted.

User dataand usage data will be archived for up to 4 years from the end of the calendaryear in which the usage contract is terminated, unless longer statutoryretention periods are relevant (e.g. in tax and commercial law in the case ofinvoices, receipts and commercial letters).

In theevent of an assertion of rights and/or legal defense, we shall retain anyenforcement titles acquired therefrom until settlement, but no longer than 31years from the end of the calendar year in which the title arose.

As far asand as soon as possible, personal data will be pseudonymized.

VII.Transfer to other countries outside the EU/EEA outside the scope of the GDPR

Wecurrently provide for data processing and data storage by contract with ourservice providers and service partners exclusively in Germany and the EU/EEA. Atransfer of the user's personal data to countries outside the EU/EEA iscurrently not actively carried out by us or our app.  

Your datawill also be processed through our branch office in Switzerland. Furthermore,it is possible that we use servers and technical providers in Switzerland tostore and manage data. In doing so, data is processed outside the directprotection provided by the DSGVO (Basic Data Protection Regulation). For theaforementioned data transfer, there is an adequacy decision of the EUCommission as a suitable guarantee for compliance with data protectionaccording to the standards of the DSGVO, so that the protection of yourpersonal rights is guaranteed when the data is transferred to Switzerland inaccordance with the requirements of the DSGVO (adequate level of dataprotection).

However, atransfer to third countries may take place through the use of the appplatform/sharing functions of the social networks, which may belong to aninternational group (e.g. with parent companies in the USA, China). The usershould therefore carefully read the privacy information, of the appplatform/social networks selected by the user as well as (future)authentication partners (social media accounts of the user). We have no influenceon this data processing by third parties selected by the user, as the selectionof these third parties is made by the user.

VIII.Processing of personal data of children

We do notknowingly collect personal data from children under the age of 16 (age limit).

If you area parent of a child under the age limit and discover that your child hassubmitted personal information to the Plactron app, please contact us atdatenschutz@plactron.com.

If we learnthat we have collected the personal data of a child under the age of 16 withoutthe consent of the parent/guardian, we will take reasonable steps to delete thepersonal data. This may result in us having to delete the user account in thePlactron app for that child.

4.right to restriction of processing

You havethe right to request Plactron to restrict processing in accordance with Art. 18DSGVO. This right exists in particular if the accuracy of the personal data isdisputed between you and Plactron, for the duration that the verification ofthe accuracy requires, as well as in the event that you request restrictedprocessing instead of erasure in the case of an existing right to erasure.Furthermore, you have the right to restriction in the event that the data is nolonger necessary for the purposes pursued by Plactron, but you require it forthe assertion, exercise or defense of legal claims, as well as if thesuccessful exercise of an objection is still disputed between Plactron and you.

5.right to data portability

You havethe right to receive from Plactron the personal data concerning you that youhave provided to Plactron in a structured, common, machine-readable format inaccordance with Art. 20 DSGVO.

6.right of revocation for data processing based on your consent

You have the right to revoke your consent todata processing at any time. However, the revocation of consent does not affectthe lawfulness of the processing carried out on the basis of the consent untilthe revocation (no revocation for the past).

Welche Daten erheben / verarbeiten / nutzen wir?Grundsätzlich können Sie die Website aufrufen, ohne persönliche Angaben zu machen. Ihr Besuch auf unseren Seiten wird jedoch protokolliert. Bei jedem Aufruf unserer Website erfasst das System automatisiert Daten und Informationen vom Computersystem des aufrufenden Rechners.
